Modern Slavery Policy

Apatchy has a zero-tolerance approach to modern slavery and human trafficking, and we are fully committed to ensuring that there is no modern slavery or human trafficking in our supply chains or in any part of our business. This Modern Slavery Statement reflects our commitment to acting ethically and with integrity in all our business relationships and to implementing and enforcing effective systems and controls to help ensure that slavery and human trafficking are not taking place anywhere in our business. Apatchy fully recognises that we have a responsibility to be aware of the risks in our business, no matter how remote the possibility, and in our wider supply chain.

We consider the risk of modern slavery, servitude or human trafficking existing within our business or supply chains to be relatively low. Our suppliers are required to agree to comply with this policy which strictly forbids all forms of slave labour. Apatchy also conducts due diligence and sanctions screenings as appropriate on suppliers to ensure that they meet Apatchy’s standards and do business only where the law and government regulations permit it. Apatchy will not work with suppliers that do not meet these standards.

1. Who we are

Apatchy Limited ("Apatchy London", "we", "us", "our") is the data controller for personal data collected through apatchy.co.uk, our customer service channels, events, pop-up stores and sample sales.

This policy explains what personal data we collect, why we use it, who we share it with, how long we keep it and the rights you have. It applies to customers in the UK, the US and anywhere else we sell to.

We process personal data in line with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, the Privacy and Electronic Communications Regulations (PECR) and, for US customers, applicable US state privacy laws.

2. What we collect

We collect personal data you give us directly, data collected automatically when you use our site, and data from partners.

Information you give us

• Contact details: name, email address, phone number, billing and delivery addresses

• Order details: products bought, order history, returns and exchanges, gift messages and personalisation text

• Account details: login details, wishlist, saved preferences, loyalty points and reviews

• Communications: emails, messages and calls with our customer service team

• Content you share with us: reviews, photos and social media posts showing Apatchy products

• Details you give at events, pop-ups, sample sales and giveaways

Information collected automatically

• Device and browsing data: IP address, approximate location, browser and device type, pages viewed, links clicked, search terms, how you arrived at our site and how long you stayed

• Session recordings and heatmaps showing how visitors use our pages (only with your consent)

• Cookie and pixel data used for analytics and advertising (only with your consent, see section 10)

Information from others

• Payment providers confirm whether a payment succeeded. We never see or store your full card details.

• Social media platforms, if you interact with us there or link your account

• Creators and affiliate partners, who tell us when a purchase came through their link

• Retail and marketplace partners, where an order placed with them is fulfilled by us

3. How we use your data

We only use personal data where we have a lawful basis to do so. The table below sets out each purpose and its basis.

Where we rely on legitimate interests, we have weighed our interests against your rights. You can object at any time (see section 8). Where we rely on consent, you can withdraw it at any time.

4. Marketing and opting out

We only send marketing emails and texts if you have opted in. You can stop them at any time:

• Email: click "unsubscribe" at the bottom of any marketing email

• Text: reply STOP to any marketing text

• Anything else: email info@apatchy.co.uk

It may take a few days for every system to update. Opting out of marketing does not stop service messages, such as order confirmations and delivery updates.

You can also turn off personalised advertising at any time by changing your cookie settings (see section 10).

5. Who we share your data with

We share personal data only with the service providers below, and only what each needs to do its job. They must keep your data secure and may only use it on our instructions, except where a provider acts as an independent controller under its own privacy policy (marked *).

We may also share personal data:

• with professional advisers such as lawyers, accountants and insurers

• where required by law, a court or a regulator, or to protect our legal rights or prevent fraud

• with a buyer or prospective buyer if we sell all or part of our business, who must follow this policy

We do not sell your personal data for money. Some advertising cookies may count as "selling" or "sharing" under certain US state laws; see section 9.

6. International transfers

Some of our service providers are based in, or store data in, the United States, Canada and the European Economic Area. Our US orders are also fulfilled from our warehouse in Austin, Texas.

When we transfer personal data outside the UK, we make sure it is protected by one of the following:

• a UK adequacy decision for that country (including the UK Extension to the EU-US Data Privacy Framework, where the US recipient is certified)

• the UK International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses

7. How long we keep your data

We keep personal data only as long as we need it for the purpose we collected it for.

We may keep some data longer if we need it to resolve a dispute, prevent fraud or meet a legal requirement.

8. Your rights

Under UK data protection law you have the right to:

• Access a copy of the personal data we hold about you

• Correct data that is wrong or incomplete

• Delete your data in certain circumstances

• Restrict how we use your data in certain circumstances

• Object to us using your data based on legitimate interests, and to direct marketing at any time

• Data portability: receive your data in a commonly used format or have it sent to another company

• Withdraw consent at any time, where we rely on consent

To use any of these rights, email info@apatchy.co.uk. We will respond within one month. We may ask you to confirm your identity first. There is usually no charge.

If you are unhappy with how we handle your data, please contact us first. You also have the right to complain to the Information Commissioner's Office (ICO) at ico.org.uk or on 0303 123 1113.

9. US residents

If you live in the United States, this section explains extra rights you may have under the laws of your state, including California, Texas, Virginia, Colorado, Connecticut and others with similar laws.

What we collect. In the last 12 months we have collected identifiers (name, email, address, IP address), commercial information (purchases and returns), internet activity (browsing and search on our site), approximate location and inferences about your shopping preferences. Sources and purposes are set out in sections 2 and 3.

Selling and sharing. We do not sell personal data for money. We do use advertising cookies and pixels (section 5) to show you Apatchy ads on other sites, which some state laws treat as "selling" or "sharing" for targeted advertising. You can opt out at any time by:

• clicking "Do Not Sell or Share My Personal Information" in our site footer

• using a browser signal such as Global Privacy Control, which we honour

Your rights. Depending on your state, you may have the right to know what we hold about you, access it, correct it, delete it, receive a copy, and opt out of targeted advertising and profiling. We will not treat you differently for using these rights.

How to make a request. Email info@apatchy.co.uk with "US privacy request" in the subject line. We will confirm receipt within 10 days and respond within 45 days. You can use an authorised agent to make a request for you. If we decline your request, you can appeal by replying to our decision, and we will respond within 45 days.

We do not collect sensitive personal data as defined by US state laws.

10. Cookies and similar technologies

Cookies are small files stored on your device when you visit a website. We also use pixels and similar tools that work in the same way.

When you first visit our site, our cookie banner lets you accept or reject non-essential cookies. We only set analytics, functionality and advertising cookies if you agree. You can change your choice at any time by clicking "Cookie settings" in our site footer.

We use Google Consent Mode, so Google tags respect your cookie choices.

Our website is not aimed at children under 16 [13 in the US] and we do not knowingly collect their data. If you think a child has given us personal data, please contact us and we will delete it.

We may update this policy from time to time. The date at the top shows when it was last updated. We will tell you about any significant changes by email or on our website.

How To Opt Out

You can control the marketing communications you receive from us. You have the following options: 

• Emails:  You can click on the ‘unsubscribe’ link in any marketing email you receive, and this will unsubscribe you from that method of communication. 
• Text Messages:  You can also text “stop” to the number provided within the communication and this will unsubscribe you from that method of communication. 
• Any method of Marketing:  You can contact our Customer Service team at info@apatchy.co.uk. Once you do this, we will update our records to ensure that you don’t receive further marketing messages. 

If you tell us you don’t want to receive marketing messages it might take a few days for all our systems to be updated, so we would ask for your patience as you might get messages from us while we process your request. 

Please note that opting out of marketing messages will not stop service communications, such as order updates.

We will no longer collect your personal information. This applies to both third-parties and the data we collect to help personalise your experience on our website or through other communications.
